Terms of Service

These Terms of Service ("Terms") govern your use of the Blue Spark Studio website and your engagement of our off-grid power, solar and battery installation services. Please read them carefully before submitting a quote request or entering into a service agreement with us.
1. Acceptance of terms
By accessing our website or requesting a quote, survey, or installation from Blue Spark Studio, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.
2. Description of services
Blue Spark Studio provides site surveys, system design, supply, installation and maintenance of off-grid and hybrid solar power systems, battery storage and backup generation for residential properties, primarily country houses in areas beyond reliable utility grid coverage.
3. Eligibility
Our services are intended for property owners or individuals with legal authority to commission work on a property. By requesting our services, you confirm that you have the right to authorize installation work at the property in question.
4. Quotes, estimates and pricing
Initial quotes are estimates based on information available before an on-site survey and are subject to revision once our engineers assess your property's actual sun exposure, roof condition, electrical infrastructure and household load. A final, binding quote will be provided in writing before any installation work begins.
5. Installation and scheduling
Installation dates are scheduled based on technician availability, weather conditions and equipment delivery timelines. We will make reasonable efforts to meet agreed schedules but are not liable for delays caused by circumstances outside our reasonable control, including those described in Section 13.
6. Payment terms
Payment terms, including any deposit, progress payments and final balance, will be set out in your service agreement. Late payments may result in a pause of scheduled work until outstanding amounts are settled. Accepted payment methods will be confirmed at the time of contracting.
7. Warranties
We provide a ten-year workmanship warranty on our installation labor, covering defects arising from our installation work under normal use. Equipment such as panels, batteries and inverters carry separate manufacturer warranties, typically ranging from 12 to 25 years, which we will help you register and claim against where applicable.
8. Limitation of liability
To the maximum extent permitted by law, Blue Spark Studio's total liability for any claim arising from our services is limited to the amount paid for the specific service giving rise to the claim. We are not liable for indirect, incidental or consequential damages, including loss of use or loss of stored data from connected devices.
9. Customer responsibilities
You are responsible for providing accurate information about your property, granting safe site access for surveys and installation, and maintaining any structural or electrical work that falls outside the scope of your agreed system, such as pre-existing wiring not part of our installation.
10. Cancellations and refunds
You may cancel a scheduled installation with reasonable notice as specified in your service agreement. Deposits may be partially non-refundable to the extent they cover equipment already ordered on your behalf or survey work already completed. Refund terms for specific circumstances will be detailed in your agreement.
11. Intellectual property
All system designs, survey reports, drawings and proposals prepared by Blue Spark Studio remain our intellectual property until full payment is received, after which you receive a license to use them in connection with your installed system, including for insurance, resale or future maintenance purposes.
12. Third-party equipment and manufacturer warranties
Solar panels, batteries, inverters and generators installed by us are manufactured by third parties. Manufacturer warranties are subject to the manufacturer's own terms and conditions, and Blue Spark Studio is not responsible for a manufacturer's failure to honor its warranty obligations.
13. Force majeure
We are not liable for delays or failures in performance resulting from events beyond our reasonable control, including natural disasters, extreme weather, equipment manufacturer shortages, government restrictions, or other events of force majeure.
14. Governing law and dispute resolution
These Terms are governed by the laws of Japan. Any disputes arising from these Terms or our services will first be addressed through good-faith negotiation and, if unresolved, submitted to the courts having jurisdiction over Katsushika-ku, Tokyo.
15. Changes to these terms
We may update these Terms from time to time to reflect changes in our services or legal requirements. Updated Terms will be posted on this page with a revised effective date, and will apply to services requested after that date.
